NPC Ukrenergo won the case in the Supreme Court

The Supreme Court of Ukraine confirmed the decisions of the courts of first and second instances, which established that NPC Ukrenergo rightfully charges fees for electricity transmission services to Kyivteploenergo. The corresponding decision was made on June 22, 2021, the press service reports.

Earlier, the Economic Court of Kyiv and the Northern Commercial Court of Appeal established that the claims of Kyivteploenergo in fact and the amount of such charges are unfounded.

As a reminder, access to the transmission system, the provision of electricity transmission services and the charging of fees for such services are carried out in accordance with the provisions of the Law of Ukraine "On the Electricity Market" and the Transmission System Code. According to these legislative acts, an agreement on the provision of electricity transmission services is concluded between NPC Ukrenergo and a market participant. The terms of the contract were approved by NEURC.

As reported, Kyivteploenergo through the court demands from NPC Ukrenergo to cancel millions of bills for the services provided.
