Ukrenergo is suing the Ministry of Energy

NPC Ukrenergo asks the Kyiv District Administrative Court to declare illegal inactivity of the Ministry of Energy and Environmental Protection, which critically delays the approval of the company's investment program for 2020, as well as oblige the Ministry to coordinate this document as soon as possible. This was reported by the press service.

The investment program is developed by NPC Ukrenergo and approved by the Regulator annually, as well as an open discussion. After that, the draft document is submitted for approval by the Ministry of Energy and Environmental Protection.

The company noted that the investment program was submitted to the Ministry of Energy on September 25, 2019.

“The criticality of the situation lies in the fact that without the approval of the investment program by the branch ministry, Ukrenergo cannot submit it for approval to the National Energy and Utilities Regulatory Commission”, the statement said.

If the investment program for 2020 is not agreed before the end of this year, then from January 1, 2020, the opportunity to implement all projects for the construction and reconstruction of networks, settlements with counterparties, including within the framework of international investment projects, will automatically be blocked.

“On September 25, the draft investment program was submitted to the Ministry of Energy for approval. However, after this, Ukrenergo did not receive any comments on the document, nor its approval. In this regard, letters were sent to the Ministry of Energy and Environmental Protection with a request to expedite the approval of the draft investment program. Moreover, in accordance with the law, the period for consideration of this type of documents cannot exceed one month from the date of receipt”, Ukrenergo noted.

In July, the Kyiv District Administrative Court upheld Ukrenergo’s lawsuit against the Ministry of Energy and declared it unlawful for the prolonged blocking of the approval of payment orders for counterparties of NPC Ukrenergo, which implemented a number of international investment projects, in particular, the creation of software for the balancing market and the market for auxiliary services – Market management system (MMS) platform.
