Naftogaz Trading won in a court to ban the name of the clone company

Gas Supply Company Naftogaz Trading won in the court to ban the use by a competitor of the similar name Naftogaz Trading, which differs only in one letter in the Ukrainian spelling, the press service reports.

The corresponding decision was made by the Economic Court of the city of Kyiv.

The court concluded that the name Naftogaz Trading makes it difficult to distinguish between two companies operating in the same market and may mislead consumers.

“Consequently, the clone firm is obliged to exclude from the full and abbreviated name the phrase ‘Нафтогаз Трейдінг’(Ukrainian), ‘Нафтогаз Трейдинг’(Russian) and ‘Naftogaz Trading’ (English). It is prohibited from using such designations in its name, domain names and publications on the Internet,” the message says.

Besides, the company must compensate Gas Supply Company Naftogaz Trading for UAH 60.5 thousand for the costs of paying the state fee and the cost of forensic examination.

The court took into account that Naftogaz Trading has been using its name since the registration of the legal entity on August 16, 2018, that is, long before the registration of the defendant company, which took place on July 6, 2020. The Naftogaz Trading brand was registered on October 12, 2020, in the State Register of Trademark Certificates of Ukraine.
