NACP: the Court of Appeal renewed the order to the Cabinet of Ministers to dismiss Vitrenko
The National Agency for Corruption Prevention (NACP) reported that the Sixth Administrative Court of Appeal upheld the appeal of the NACP and cancelled the ruling of the Kyiv District Administrative Court, which stopped the NACP’s order to the Cabinet of Ministers to terminate the contract with Yurii Vitrenko, the Head of the Board of NJSC Naftogaz of Ukraine.
In the order, the NACP demanded that the government cancel clauses 8 and 9 of the Cabinet of Ministers order No.370-r and resolve the issue of terminating the contract with Yurii Vitrenko, Head of the Board of NJSC Naftogaz of Ukraine.
"Due to the court's decision, the order of the NACP to the Cabinet of Ministers regarding the illegal appointment of the Head of the Board of NJSC Naftogaz of Ukraine is subject to execution," said the Head of NACP.
“We would like to draw your attention to the fact that one of the grounds for initiating the case was the alleged impossibility of cancelling items 8 and 9 of the above-mentioned order by the government. That is why Oleksandr Novikov sent a letter to the Cabinet of Ministers, which explains that the law provides for a specific mechanism for fulfilling the order,” the department explained.
According to the NACP, it is necessary to convene a meeting of the government and initiate consideration of the following issues:
- cancellation as illegal paragraphs 8 and 9 of the order of the government No.370-r. Cancellation of clause 9 of this order is required only in terms of signing a contract with the head of the board of NJSC Naftogaz of Ukraine since it was his conclusion that was carried out in violation of Art.26 of the Law of Ukraine "On Prevention of Corruption";
- termination of the contract with the Head of the Board of NJSC Naftogaz of Ukraine as illegal.
“NACP is ready to provide consulting support in the implementation of the order. Our priority is to ensure the operation of the Law of Ukraine "On the Prevention of Corruption," Novikov added.
