The Supreme Court accepted for consideration the cassation appeal of the Cabinet of Ministers against the decision of the courts of previous instances, which deprived the government of the right to appoint and dismiss the head and members of the board of NJSC Naftogaz of Ukraine bypassing the Supervisory Board.
“To open the cassation proceedings on the cassation appeal of the Cabinet of Ministers against the decision of the Kyiv District Administrative Court and the decision of the Sixth Administrative Court of Appeal on securing the claim in this case”, the court decision said.
Recall that the District Administrative Court had declared the Cabinet of Ministers’ Decree No.226 of March 6 unlawful and invalid, which gives the meeting of shareholders the authority to elect and dismiss the head and members of the board of Naftogaz without a Supervisory Board.
