The Regulator fined 4 more regional gas companies because of the additional charges in the payment. By 3.4 million UAH

As a result of unscheduled inspections, the national Regulatory Commission imposed a fine on four gas distribution network operators for additional gas consumption volumes in bills. The total amount of fine is 3.4 million UAH.   

This decision was made today at a meeting of the Energy and Utilities the National Regulatory Commission.

The Regulator’s decision relates to the companies Mykolaivgaz, Kharkivgorgaz, Sumygaz, and Dniprogaz, which are members of the Regional Gas Company (RGC) group, which belongs to businessman Dmytro Firtash. Penalties for each GTS operator amounted to 850 thousand UAH, which is the maximum amount of financial recovery in this case.

The Regulator imposed a penalty for violating the license conditions in terms of bringing the volumes of used natural gas by household consumers to standard conditions, which led to additional charges in consumers' payments.

The National Regulatory Commission obliged companies to recalculate for those specific consumers that were checked, and also to recalculate additional charges for the entire period starting from October 2018, for all consumers for which such additional charges were made, until April 26, 2019.

According to the decision, the Regulator will send an appeal to the Antimonopoly Committee of Ukraine to investigate the abuse of the monopoly position of the company.

In addition, according to the results of the scheduled inspection of the GDS Dniprogaz operator, other violations were identified, for which the Regulator has fined the company an additional 850 thousand UAH. Among such violations was non-installation of gas meters for 22% of its consumers. The National Commission obliged the reginal gas company to do the installation of new and verification of expired meters. Thus, the company Dniprogaz was fined 1.6 million UAH.  

In addition, Chernihivgaz, which was previously fined, is not in agreement with the fines of the National Regulatory Commission for Energy Regulation of the Republic of Kazakhstan for bringing gas volumes to standard conditions. It is seen discrimination against consumers in the actions of the Commission and will appeal against it in court as contrary to the norms of the legislation of Ukraine.

 “The inspection report does not indicate a specific rule of law that Chernihivgaz violated. But instead of eliminating obvious gaps in the standardization, put consumers in equal conditions, which is actually one of the main functions of an independent regulator, it punishes regional gas with fines for compliance with the law adopted by it”, said Alla Yarovaya, the Chairman of the Board of Chernihivgaz .

Between all the market participants, natural gas is transferred only under standard conditions. And in case of deviation from the standards, in the process of distribution and supply of gas there is a multimillion deficit of funds, which the state does not compensate, the regional gas company reports.
