The U.S. Federal Court in NY ruled in favour of NJSC “Naftogaz Ukrainy” for information from three American financial institutions (GLAS Americas, Deutsche Bank Trust Company Americas и Bank of New York) to disclose the information on the “Gazprom” assets in Europe.
This information was provided by NJSC “Naftogaz Ukrainy” press office.
“Naftogaz” will send appropriate summons to these companies in coming days”, as it is noticed in a press release.
“Naftogaz” has sued to U.S. Federal Courts in NY and Texas requesting 5 registered in the U.S companies to provide the information on the “Gazprom” assets in Europe on December 6.
This is being done in order to enforcement arbitral award on payment to “Gazprom” $2.6 billion.

Claims in NY court particularly as been submitted regarding to GLAS Americas LLC financial company, which is expected to have information on the location of shares of Swiss company Nord Stream 2 AG, which belonging to “Gazprom”. “Naftogaz” needs this information to sue in Switzerland to arrest Nord Stream 2 AG’s shares.
Deutsche Bank Trust Company Americas presence in this list is explained by the fact that it is a correspondent bank of Moscow “Gazprompank”, where “Gazprom’s” account is opened, NJSC “Naftogaz Ukrainy” press office says. In their turn, “Gazprombank” has Swiss Affiliates company Gazprombank (Switzerland) Ltd. and “Naftogaz” requires Deutsche Bank to provide information on «Gazprom’s” operations with “Gazprombank (Switzerland) Ltd.” including accounts numbers in order to sue for seizure of funds on these accounts. It will be sued in Switzerland as well.
Bank of New York Mellon is a bank, which manages “Gazprom’s” ADR program and probably has information about last operations of “Gazprom” with its Dutch subsidiaries shares, noticed in NJSC message.
NJSC “Naftogaz” requires this information to sue the “Gazprom” to recover damages due to unlawful conclusion of assets from “Gazprom” ownership. This claim is planning to be sued in Netherlands.
Oil and gas consulting company DeGolyer & MacNaughton, which audits oil and gas reserves for “Gazprom” was included in the list as they can have the information about “Gazprom’s” projects on oil and gas production, their corporate structure and its changing plans, that is necessary for sueing in Netherlands court, noticed in NJSC’s message.
Gazprom Marketing & Trading USA Inc. is a company, which “Gazprom” owns indirectly and which can have information on the last Russian company’s operations connected with shares transmission to Dutch subsidiaries, the bank accounts of “Gazprom” in Switzerland and the location of the “Nord Stream – 2” shares owned by “Gazprom”.
“Naftogaz” is also planning to use this information for claims’ preparation in Netherlands and Switzerland.
““The United States is the most important jurisdiction. It requires the most time-consuming, but it can have the most effective consequences”, commented Andrei Kobolev, the Head of the Board of the NJSC on appeals to the American court. NJSC Executive Director Yury Vitrenko in the evening of December 12 clarified that the company is currently awaiting a court decision in Texas.
